                       美国2000-2007法学人物影响力排行榜

                              刘双舟

    今天在法律博客上看到了“当代中国法学名家”名单(第二批)。这其中有些是熟人,他们的成就我还是很佩服的,也有些不太了解,甚至没有听说过,当然这主要应当归咎于本人的孤陋寡闻,而不敢私下揣度上榜者做出的贡献。

    但是有一点我还是不明白,即在公布评选结果的同时,为什么不能将评选的标准也一并公布呢,明确标准,这样不更有利于“后进们”明确奋斗目标并激励他们向名家学习和看齐吗?

    热衷于排名不是国人独有的偏好,美国人也爱搞这一套,谁向谁学的?这一点可能并不重要。但美国人在搞排名时有两点与国人不同:

    一是他们会标明有效期,即告诉大家这是那一时间段的排名,而不像国人搞终身制,国人的排行榜只有批次,没有时效,给人的印象是,好像只要上了名家榜,就永远是名家了;

    二是美国人在公布排名时,同时会公布上榜的评价标准,评价标准非常清楚,就是你的学术文章的引用率的多少。你是如何上榜的,你排在第几位,一清二楚。不但公众看的明白,上榜者之间也不会因为出场的先后顺序而相互不服气从而引发新的纠纷。当然,国人很聪明,用个“按姓氏笔画排列”来解决问题,但是这也只是解决了表面问题,实质上谁先谁后的问题还是没有解决。

    下面转摘的是美国2000-2007期间法学人物影响力排行榜(部分学科),鄙人才疏学浅,不知道是否也应该翻译为“美国当代法学名家”名单?

    大家自己看看吧。
